2. Introduction
By using the Cotoon App ("Service") provided by Toon Collaboration Platform ("Company" or "Cotoon"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). If you do not agree to these Terms of Service, do not use this Service. By accepting these Terms of Service below or by using the Service in any manner, you and the entity you represent ("Customer") agree that you have read and agree to be bound by this agreement to the exclusion of all other terms.
Violation of any of the terms below may result in the termination of your account.
3. Account Terms
- Security: You are responsible for maintaining the security of your account and password.
- Responsibility: You are responsible for all content posted and activity that occurs under your account.
- Compliance: You may not use the Service for any illegal purpose or to violate any laws in your jurisdiction.
- Information: You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
- Access: Your login may only be used by one person – a single login shared by multiple people is not permitted.
- Automation: You must be a human. Accounts registered by "bots" or other automated methods are not permitted if they are used for purposes other than plugging into your production pipeline.
4. Software & API Terms
Customers may access their Service data via the API, as well as through the Cotoon Desktop App and Blender Bridge. Any use of the API or native plugins is bound by this agreement plus the following:
- Liability: The Company shall not be liable for any damages resulting from your use of the API or desktop integrations.
- Abuse: Excessive requests to the Service via the API may result in suspension of your account's access.
5. Payment, Refunds, Upgrading, and Downgrading Terms
- Billing: Following any offered free trial, the Customer is invoiced or billed automatically via Stripe.
- Seat Usage: The number of seats purchased must be used during the applicable term.
- Overage: Usage exceeding the plan limit may incur additional overage fees.
- Tier Changes: Upgrades or downgrades take effect at the next billing cycle.
- Refunds: Monthly plans are billed in advance and are non-refundable. As a B2B service, the EU consumer right of withdrawal does not apply.
- Taxes: All fees are exclusive of taxes. You are responsible for all applicable taxes.
6. Cancellation and Termination
- Process: You can cancel your account at any time through the billing or account settings within the platform.
- Data Deletion: All content will be inaccessible immediately upon cancellation and permanently deleted within 30 days.
- Company Rights: The Company may suspend or terminate your account for any reason at any time.
7. Copyright and Content Ownership
- Your Assets: You retain full ownership of all content you upload. We claim no intellectual property rights over your material.
- Cotoon's IP: The look and feel of the Service is copyright © 2026 Cotoon Platform. All rights reserved.
- Trademarks: "Cotoon", the Cotoon logo, and any other product names are trademarks of the Company.
8. Data Protection & GDPR
The Company handles personal data in compliance with the GDPR and the French Data Protection Act.
- Your Rights: You retain the right to access, rectify, port, and erase your personal data at any time.
- Data Processing: User data is solely used to provide, maintain, and improve the Service.
- Security: The Company implements appropriate technical and organizational security measures.
9. Governing Law & General Conditions
- Jurisdiction: This Agreement is governed by the laws of France.
- Risk: Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.
- Uptime: We do not warrant that the service will be entirely uninterrupted, timely, secure, or error-free.
- Liability limitation: To the fullest extent permitted by applicable law, the Company shall not be liable for any damages resulting from use or inability to use the service.
